Big Lee's Furniture Liquidation – Terms and Conditions

These Terms and Conditions (“Agreement”) apply to the use of the services and products offered by Big Lee's Furniture Liquidation (“we,” “us,” “our”), located at [Insert address here], and govern your purchase, use, and return of products from our store. By purchasing from us, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions.

1. Return & Exchange Policy

At Big Lee's Furniture Liquidation, customer satisfaction is important. However, due to the nature of our products, we have specific return policies that must be followed. Please review these policies carefully.

1.1 General Returns (30-Day Return Policy)

  • Most items purchased from Big Lee's Furniture Liquidation are eligible for return within 30 days of purchase.

  • Returns must be in new, unused, and resalable condition, with the original packaging, and proof of purchase (receipt or order confirmation).

  • Items returned in used or damaged condition will not be accepted for return.

  • Returned products must include all original parts and accessories (e.g., hardware, instruction manuals, etc.).

  • Return Process: To initiate a return, please contact our customer service team for instructions. Once your return is approved, you will receive a return merchandise authorization (RMA) number. Returns without an RMA will not be processed.

  • Return Shipping: You are responsible for the return shipping costs unless the return is due to a mistake on our part (e.g., defective or damaged items).

  • Store Credit Only: Returns will be processed as store credit only, which can be applied toward future purchases at Big Lee's Furniture Liquidation. No cash, credit card refunds, or exchanges will be issued.

  • Non-refundable Charges: Delivery charges, installation fees, or any other non-product fees are non-refundable.

1.2 Mattress Returns (3-Day Return Policy)

  • Mattresses are eligible for return within 3 days of the original purchase date, subject to the following conditions:

    • The mattress must be unused and in the original packaging.

    • If the mattress packaging has been removed or the mattress has been used, the return will be refused.

    • Once a mattress has been used or removed from its original packaging, it cannot be returned under any circumstances.

    • Return Process: To process a mattress return, please contact our customer service team within 3 days of receiving the mattress. Returns will only be accepted with an RMA number.

    • Store Credit Only: Like other returns, mattress returns will be processed as store credit only.

1.3 Final Sale Items

  • The following items are final sale and cannot be returned or exchanged under any circumstances:

    • Special orders or custom-made items

    • Clearance or discounted items (marked as “final sale”)

    • Items that have been assembled, used, or altered

2. Right to Refuse Returns and Exchanges

Big Lee's Furniture Liquidation reserves the right to refuse any return or exchange for the following reasons:

  • The item does not meet the return criteria outlined in this Agreement.

  • The item has been assembled, used, or is damaged beyond normal wear and tear.

  • The return is made after the applicable return period (30 days for most items, 3 days for mattresses).

  • We suspect fraudulent activity, including returns that are made with altered or forged receipts or unauthorized chargebacks.

All returns are at the discretion of the store management, and we reserve the right to limit returns or exchanges on a case-by-case basis.

3. Disputes and Chargebacks

By purchasing products from Big Lee's Furniture Liquidation, you acknowledge and agree to the following:

  • Chargeback Policy: Any customer who disputes charges for purchases made at Big Lee's Furniture Liquidation after receipt of the goods will be subject to prosecution to the fullest extent of the law, as outlined under the Florida Code Annotated Statutes. You agree to resolve any disputes in a timely manner through our customer service team before escalating to chargebacks or other legal avenues.

  • Legal Recourse: In the event of a chargeback, we will pursue the full payment of the outstanding balance plus any legal fees or charges incurred through the dispute. We will also report fraudulent chargebacks to the appropriate authorities, and we reserve the right to terminate your customer account and deny future purchases from us.

4. Damaged or Defective Merchandise

We strive to provide high-quality products, but if your item arrives damaged or is defective, please follow these guidelines:

  • Contact Us Immediately: Notify our customer service team within 48 hours of receiving the damaged or defective item. Please provide detailed information, including photos, of the damage or defect.

  • Return Process: Once the issue is confirmed, we will assist you in arranging a replacement, exchange, or store credit. Items returned due to damage or defects may be eligible for a full refund or store credit, depending on the situation.

  • Return of Damaged Items: You may be required to return the damaged item as part of the resolution process, and return shipping fees will be covered by Big Lee's Furniture Liquidation if the item is deemed defective or damaged during delivery.

5. Payment Terms

  • Accepted Payment Methods: We accept most major credit and debit cards, including Visa, MasterCard, Discover, and American Express, as well as financing options, where available.

  • Pricing: All prices are subject to change without prior notice. We reserve the right to correct any pricing errors, including those in advertisements, promotional materials, or our website. Any pricing discrepancies will be addressed prior to the completion of the purchase.

  • Sales Tax: Sales tax will be applied where required by law.

6. Limitation of Liability

To the fullest extent permitted by law, Big Lee's Furniture Liquidation will not be liable for any indirect, incidental, special, punitive, or consequential damages, including but not limited to loss of profits or damage to property, arising from the use of our products or services, even if we have been advised of the possibility of such damages.

Our liability is limited to the amount paid by the customer for the item(s) in question.

7. Warranty Disclaimer

Except as otherwise expressly stated in this Agreement, all products are sold as is, without any warranties, express or implied. We disclaim all warranties, including implied warranties of merchantability or fitness for a particular purpose, and will not be responsible for any damages arising from the use or misuse of the products.

8. Governing Law and Dispute Resolution

This Agreement shall be governed by the laws of the State of Florida, without regard to its conflicts of law principles. Any dispute arising under or in connection with these Terms and Conditions shall be resolved in the appropriate courts located in the jurisdiction of Miami-Dade County, Florida.

9. Legal and Binding Agreement

By purchasing from Big Lee's Furniture Liquidation, you confirm that you have read, understood, and agree to these Terms and Conditions. This Agreement constitutes a legally binding contract between you and Big Lee's Furniture Liquidation.

If any portion of these Terms and Conditions is found to be invalid or unenforceable, the remainder of the Agreement will remain in full effect.

10. Modifications to Terms and Conditions

Big Lee's Furniture Liquidation reserves the right to modify, update, or change these Terms and Conditions at any time without prior notice. Any changes will take effect immediately upon posting to our website. By continuing to use our services after such changes are made, you agree to be bound by the updated Terms and Conditions.
